Kent Law Clinic: case updates

Case updates from Kent Law Clinic’s weekly Tuesday meeting (led by the Student Committee Vice-Chair Terrie):

Mobile home case: Kent Law Clinic solicitor Vivien Gambling is representing a client who is owed money for a mobile home that he bought (but never took possession of) and which the mobile home park owners (who initially sold it to him) had agree to sell on for him. There will be a hearing on Monday next week to consider whether there has been a breach of contract and/or unjust enrichment.

Employment law case: The Law Clinic’s Employment Law Adviser Tony Pullen and law student Jas discussed a new case they have taken on which involves discrimination law and a claim for unfair dismissal. Tony summarised the nine ‘protected characteristics’ described by the Equality Act 2010 as: age; disability; gender reassignment; marriage and civil partnership; pregnancy and maternity; race; religion or belief; sex ie gender; sexual orientation. Together with Jas, Tony then led an interesting discussion on veganism as a “philosophical belief” and whether the law might afford their client protection against discrimination on the ground of “religion and belief”. Tony informed students that, under Section 10 of the Equality Act 2010, a belief can only qualify for protection if it: is genuinely held; is not simply an opinion or viewpoint based on the present state of information available; concerns a weighty and substantial aspect of human life and behaviour attains a certain level of cogency, seriousness, cohesion and importance; and is worthy of respect in a democratic society, is not incompatible with human dignity and is not in conflict with the fundamental rights of others.
