{"id":937,"date":"2015-09-18T11:40:24","date_gmt":"2015-09-18T10:40:24","guid":{"rendered":"http:\/\/blogs.kent.ac.uk\/law-news\/?p=937"},"modified":"2015-09-18T11:40:24","modified_gmt":"2015-09-18T10:40:24","slug":"kent-professor-nick-grief-instructed-as-expert-witness-in-aggravated-trespass-case","status":"publish","type":"post","link":"https:\/\/blogs.kent.ac.uk\/law-news\/kent-professor-nick-grief-instructed-as-expert-witness-in-aggravated-trespass-case\/","title":{"rendered":"Kent Professor Nick Grief instructed as expert witness in aggravated trespass case"},"content":{"rendered":"<p><span style=\"color: #333333;font-family: 'Calibri','sans-serif';font-size: 11pt\">A report prepared by Kent Professor Nick Grief\u00a0has been relied on by two anti-nuclear protesters acquitted of committing aggravated trespass at HM Naval Base Devonport contrary to s 68(1) of the Criminal Justice and Public Order Act 1994.<\/span><\/p>\n<p><span style=\"color: #333333;font-family: 'Calibri','sans-serif';font-size: 11pt\">The charge\u00a0related to an incident on 25 July 2014 when defendants Nicola Clark and Theo Simon chained themselves to a car parked on an approach road to Devonport Naval Base. The road led to the site where\u00a0one of the\u00a0UK&#8217;s four\u00a0Trident submarines, HMS Vengeance,\u00a0was undergoing maintenance and refit.<\/span><\/p>\n<p><span style=\"color: #333333;font-family: 'Calibri','sans-serif';font-size: 11pt\">Relying on the report prepared by Professor Grief, which was read out in court unchallenged during their trial in Plymouth earlier this month, the defendants argued that Trident and the associated refit activity are unlawful under international law and English law. Explaining their acquittal, <\/span><span style=\"color: #333333;font-family: 'Calibri','sans-serif';font-size: 11pt\">Professor Grief said: &#8216;Without commenting on the legality of Trident or of the refit activity, District Judge Gray ruled that the defendants had been on the highway, not on \u2018land\u2019, and therefore the prosecution had not proved the offence of aggravated trespass.&#8217;<\/span><\/p>\n<p><span style=\"color: #333333;font-family: 'Calibri','sans-serif';font-size: 11pt\"><a href=\"https:\/\/www.kent.ac.uk\/law\/people\/academic\/Grief,_Nick.html\"><span style=\"color: #0000ff;font-family: Calibri\">Professor Grief<\/span><\/a> teaches Public International Law and EU Law at Kent Law School and is\u00a0Dean for the University of Kent\u2019s Medway campus.
