{"id":7721,"date":"2023-10-11T13:21:51","date_gmt":"2023-10-11T12:21:51","guid":{"rendered":"https:\/\/blogs.kent.ac.uk\/law-news\/?p=7721"},"modified":"2023-10-11T13:21:51","modified_gmt":"2023-10-11T12:21:51","slug":"summer-at-kent-law-clinic","status":"publish","type":"post","link":"https:\/\/blogs.kent.ac.uk\/law-news\/summer-at-kent-law-clinic\/","title":{"rendered":"Summer at Kent Law Clinic"},"content":{"rendered":"<p class=\"lead\">New cases and case updates<\/p>\n<p>Remember\u00a0Summer 2023 &#8211; hot and dry,\u00a0cold,\u00a0and wet, and then hot and dry again.\u00a0With students\u00a0away,\u00a0the\u00a0university\u00a0was unimaginably\u00a0quiet\u00a0&#8211;\u00a0apart from grass cutting, tree felling and dog walkers\u2026<\/p>\n<p>But\u00a0in\u00a0the Clinic\u00a0legal\u00a0work continued.\u00a0Legal problems follow the law\u2019s timetable\u00a0which is dictated by the urgency of the matter and deadlines imposed by\u00a0the courts and legal process in general.\u00a0Our cases do not conveniently settle or conclude\u00a0at\u00a0the end of\u00a0the academic\u00a0term.<\/p>\n<p>Since there is no holiday from the law the\u00a0Clinic\u00a0\u2018s\u00a0solicitors and\u00a0supervisors\u00a0continued to\u00a0work on\u00a0cases. People in Kent still contacted the Clinic \u2013 often with pressing problems that\u00a0couldn\u2019t\u00a0wait.<\/p>\n<p>What follows is an account of just some of the\u00a0work of the Clinic over the summer months. Some of the cases and enquiries will continue. You never know, if you are a law student and join the Law Clinic you might work on one of them this\u00a0term.<\/p>\n<p>Click on the links below to find out more\u2026.<\/p>\n<p><a href=\"https:\/\/blogs.kent.ac.uk\/kentlawclinic\/employment-law-redress-for-being-sacked-or-unlawfully-treated\/\"><strong>Employment Law \u2013 redress for being sacked or unlawfully treated<\/strong><\/a><\/p>\n<p>Elaine Sherratt and Tony Pullen, the Clinic&#8217;s employment lawyers, help clients with claims arising from being unfairly dismissed by their employer or who experience discrimination or other issues in the workplace.<em>\u00a0<\/em><\/p>\n<ul>\n<li><strong>Compensation for sacked care home workers <\/strong><\/li>\n<li><strong>Discrimination related to pregnancy<\/strong><\/li>\n<li><strong>Successfully negotiated retirement<\/strong><\/li>\n<li><strong>Whistleblowing claim upheld<\/strong><\/li>\n<\/ul>\n<p><a href=\"https:\/\/blogs.kent.ac.uk\/kentlawclinic\/family-law-court-orders-to-protect-childrens-welfare\/\"><strong>Family Law &#8211; court orders to protect children&#8217;s welfare<\/strong><\/a><\/p>\n<p>During the summer Philippa Bruce, Law Clinic Solicitor, has dealt with three cases involving the question whether someone who is not the parent of a child they are caring for needs a Special Guardianship Order (SGO). This Order is needed where there are several people with \u2018parental responsibility\u2019 in law but where it is in the best interests of the child to give overriding authority to one particular person who can be trusted to look after the child properly.<\/p>\n<ul>\n<li><strong>Special Guardianship Order for a child\u2019s grandmother<\/strong><\/li>\n<li><strong>Court order needed to enable child\u2019s medical treatment<\/strong><\/li>\n<\/ul>\n<p><a href=\"https:\/\/blogs.kent.ac.uk\/kentlawclinic\/civil-litigation-people-at-risk-of-losing-their-homes\/\"><strong>Civil Litigation \u2013 people at risk of losing their homes<\/strong><\/a><\/p>\n<p>The Clinic deals with a range of civil litigation, we receive lots of requests for help from people whose homes are at risk or who are experiencing other housing issues.<\/p>\n<p>With some enquiries the subject matter of the legal problem is obvious. However, a proportion of enquiries from the public resist any easy classification. They raise issues and questions which don\u2019t fall clearly in any one distinct area of law or practice.<\/p>\n<p>Graham has noticed an increase in the numbers of cases in which older or otherwise vulnerable people have been persuaded, bullied, or swindled out of money and\/or property rights by other relatives.<\/p>\n<p>Here are a couple of the cases which Vivien Gambling, Clinic Solicitor, and Graham Tegg, Director of the Law Clinic are currently dealing with.<\/p>\n<ul>\n<li><strong>Family\u2019s home at risk<\/strong><\/li>\n<li><strong>Property and Land Law? Defending a vulnerable person who has been swindled<\/strong><\/li>\n<\/ul>\n<p><a href=\"https:\/\/blogs.kent.ac.uk\/kentlawclinic\/disability-benefits-law-helping-people-navigate-appeals\/\"><strong>Disability Benefits Law \u2013 helping people navigate the appeals process<\/strong><\/a><\/p>\n<p>Over the summer the Clinic has continued to focus its limited resources on challenges to PIP and DLA for children. Here are a few of the cases we have dealt with:-<\/p>\n<ul>\n<li><strong>A Successful PIP Appeal<\/strong><\/li>\n<li><strong>Technology delays disability benefit appeal<\/strong><\/li>\n<li><strong>Appeal to the Upper Tribunal<\/strong><\/li>\n<li><strong>Client facing multiple legal problems<\/strong><\/li>\n<\/ul>\n<p><a href=\"https:\/\/blogs.kent.ac.uk\/kentlawclinic\/immigration-law-appeals-more-appeals-and-the-long-road-to-reuniting-families\/\"><strong>Immigration Law &#8211; appeals, more appeals and the long road to reuniting families<\/strong><\/a><\/p>\n<p>Dr Richard Warren, an Immigration Adviser, has dealt with five appeals during the summer. Two appeals, dealing with refugee family reunion, were allowed \u2013 but that is not the end of those cases! Here are brief details of a few of our cases.<\/p>\n<ul>\n<li><strong>Two Afghan brothers stuck in Iran<\/strong>.<\/li>\n<li><strong>No right to remain in the UK after 18<sup>th<\/sup> birthday<\/strong><\/li>\n<li><strong>Dilemma of a young married couple <\/strong><\/li>\n<li><strong>Applying due to serious health condition <\/strong><\/li>\n<\/ul>\n<p><a href=\"https:\/\/blogs.kent.ac.uk\/kentlawclinic\/safe-and-legal-routes-for-refugee-family-reunion-two-legal-successes-and-practical-realities\/\">Safe and legal routes for refugee family reunion \u2013 two legal successes and practical realities<\/a><\/p>\n<p>The refugee family reunion cases that the Clinic&#8217;s immigration lawyers, solicitor Sheona York and Dr Richard Warren deal with illustrate the inadequate provisions made for \u2018safe and legal routes\u2019 for refugee family members to come to the UK to join their families.<\/p>\n<p>You can<strong> <a href=\"https:\/\/blogs.kent.ac.uk\/kentlawclinic\/safe-and-legal-routes-for-refugee-family-reunion-two-legal-successes-and-practical-realities\/\">read here<\/a> <\/strong>about two clients, who cases were successful, and whose stories show how long and tortuous the process can be.<strong>\u00a0<\/strong><\/p>\n<p>Besides the continuing casework, the Clinic\u2019s immigration lawyers are facing radical changes in the legal landscape. We have been following and blogging about the Rwanda judgment and the contentious Illegal Migration Act 2023.
