{"id":899,"date":"2021-05-31T06:29:33","date_gmt":"2021-05-31T05:29:33","guid":{"rendered":"http:\/\/blogs.kent.ac.uk\/eu-rights-clinic\/?p=899"},"modified":"2021-05-31T06:41:06","modified_gmt":"2021-05-31T05:41:06","slug":"euss-survey","status":"publish","type":"post","link":"https:\/\/blogs.kent.ac.uk\/eu-rights-clinic\/euss-survey\/","title":{"rendered":"EU Rights Clinic seeks your views in EU Settlement Scheme survey"},"content":{"rendered":"<p><strong>The EU Rights Clinic has launched a <a href=\"https:\/\/kent.onlinesurveys.ac.uk\/euss-survey\">survey<\/a> to identify recurring issues with the <a href=\"https:\/\/www.gov.uk\/settled-status-eu-citizens-families\">EU Settlement Scheme<\/a>.<\/strong><\/p>\n<p><span style=\"color: #000000\">Following the United Kingdom&#8217;s exit from the EU, the<\/span> <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/ALL\/?uri=celex:12020W\/TXT\">Withdrawal Agreement<\/a> <span style=\"color: #000000\">aims to protect the rights of EU nationals living in the United Kingdom. Pursuant to this Agreement, as well as<\/span> <a href=\"https:\/\/www.gov.uk\/government\/news\/uk-agreements-with-the-eea-efta-states-and-switzerland\">agreements reached with EEA countries and Switzerland<\/a>, <span style=\"color: #000000\">the UK has introduced the<\/span> <a href=\"https:\/\/www.gov.uk\/settled-status-eu-citizens-families\">EU Settlement Scheme<\/a>, <span style=\"color: #000000\">which enables EU, EEA and Swiss nationals to apply for a special immigration status that allows them to remain in the UK after\u00a0 Brexit.<\/span><\/p>\n<p><span style=\"color: #000000\"><strong>Since the scheme was opened for applications, numerous issues have been reported<\/strong> (examples\u00a0can be found<\/span><a href=\"https:\/\/blogs.lse.ac.uk\/politicsandpolicy\/why-the-eu-settlement-scheme-is-not-good-enough-as-it-is\/\"> here<\/a>,<a href=\"https:\/\/blogs.lse.ac.uk\/brexit\/2020\/05\/06\/there-are-cracks-in-the-eu-settlement-scheme-who-will-fall-through-them\/\"> here<\/a>, <span style=\"color: #000000\">and<\/span><a href=\"https:\/\/www.theguardian.com\/politics\/2019\/aug\/30\/eu-citizens-uk-settled-status-alarm\"> here<\/a>)<strong><span style=\"color: #000000\"> and extensive reports highlighting problems have been produced by<\/span> <a href=\"http:\/\/t3m.org.uk\/IMA_report\">the3million<\/a> <span style=\"color: #000000\">and the<\/span> <a href=\"https:\/\/www.eurightshub.york.ac.uk\/blog\/tripwiresandtimebombsmay21\">University of York\u2019s EU Rights and Brexit Hub<\/a> <\/strong><span style=\"color: #000000\">among others.<\/span><\/p>\n<p><span style=\"color: #000000\">In view of these problems, <strong>the EU Rights Clinic is currently conducting a survey (which can be found<\/strong><\/span><strong><a href=\"https:\/\/kent.onlinesurveys.ac.uk\/euss-survey\"> here<\/a>) <span style=\"color: #000000\">on the EU Settlement Scheme and its application to date. <\/span><\/strong><span style=\"color: #000000\">The aim of this survey is to obtain data on applicants&#8217; experiences with the scheme, which may then be used<\/span><strong><span style=\"color: #000000\"> to file official complaints with the<\/span><a href=\"https:\/\/ima-citizensrights.org.uk\/\">Independent Monitoring Authority<\/a><span style=\"color: #000000\">and the<\/span><a href=\"https:\/\/ec.europa.eu\/info\/relations-united-kingdom\/eu-uk-withdrawal-agreement\/meetings-eu-uk-joint-and-specialised-committees-under-withdrawal-agreement_en#meetingsofthespecialisedcommittees\">EU institutions<\/a>.<\/strong><\/p>\n<p><span style=\"color: #000000\">Possible issues include, but are not limited to:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000\"><strong>Technical issues<\/strong>, such as the application not being available on specific phone operating software, problems scanning the ID documents or non-biometric passports, problems with accessing the website, problems in proving presence in the UK, etc.<\/span><\/li>\n<li><span style=\"color: #000000\"><strong>Covid-19-related issues<\/strong>, especially those caused by the various lockdown phases and the restrictions on international travel which may have impacted on the ability of EU citizens to return to the UK.<\/span><\/li>\n<li><span style=\"color: #000000\">Issues caused by the use of a<strong> \u201cdigital status\u201d<\/strong> <strong>and the lack of a physical residence card<\/strong>, which makes it difficult for EU, EEA, and Swiss nationals to prove their status in the UK .<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000\">If you have applied, or intend to apply, or are not yet sure about applying to the EU Settlement Scheme, we would like to<\/span> <a href=\"https:\/\/kent.onlinesurveys.ac.uk\/euss-survey\">hear your views and experiences<\/a>.<span style=\"color: #000000\"> If you are an adviser or legal representative, we would also welcome you<\/span> <a href=\"https:\/\/kent.onlinesurveys.ac.uk\/euss-survey\">sharing the details of any problems<\/a> <span style=\"color: #000000\">your clients may have encountered when applying for EU settled or pre-settled status.<\/span><\/p>\n<p><strong><span style=\"color: #000000\">We would greatly appreciate you taking the time to participate in this<\/span><a href=\"https:\/\/kent.onlinesurveys.ac.uk\/euss-survey\"> survey<\/a>.<\/strong> <span style=\"color: #000000\">Your experience will contribute to our research into the larger picture of how successfully the rights of EU, EEA, and Swiss nationals have been protected post-Brexit.<\/span><\/p>\n<p><span style=\"color: #000000\">Any <strong>data obtained through the survey will be treated confidentially<\/strong>, and no personal information will be mentioned in any formal complaint.
