{"id":727,"date":"2017-12-13T17:12:29","date_gmt":"2017-12-13T17:12:29","guid":{"rendered":"http:\/\/blogs.kent.ac.uk\/eu-rights-clinic\/?p=727"},"modified":"2017-12-13T18:17:23","modified_gmt":"2017-12-13T18:17:23","slug":"brexit-safeguarding-citizens-rights","status":"publish","type":"post","link":"https:\/\/blogs.kent.ac.uk\/eu-rights-clinic\/brexit-safeguarding-citizens-rights\/","title":{"rendered":"Brexit: EU Rights Clinic Calls For Rights of EU Citizens and Family Members to be Fully Protected"},"content":{"rendered":"<div class=\"entry clr\">\n<p>The EU Rights Clinic has submitted letters to the <a href=\"https:\/\/ec.europa.eu\/info\/departments\/taskforce-article-50-negotiations-united-kingdom_en\">European Commission\u2019s Brexit Task Force<\/a> and the <a href=\"http:\/\/www.europarl.europa.eu\/brexit-steering-group\/en\/home\/home.html\">European Parliament\u2019s Brexit Steering Group<\/a> to express its concerns about the protections granted to the rights of EU citizens and their family members living in the UK following the <a href=\"https:\/\/ec.europa.eu\/commission\/files\/joint-report-negotiators-european-union-and-united-kingdom-government-progress-during-phase-1-negotiations-under-article-50-teu-united-kingdoms-orderly-withdrawal-european-union_en\">recent agreement<\/a> reached by the EU and the UK which concludes the first phase of negotiations on the terms of the UK\u2019s withdrawal from the EU.<\/p>\n<p>Urgent confirmation is sought from the European Commission and European Parliament that the rights of various categories of EU citizens and family members who currently enjoy rights of residence under EU law will be fully protected under the terms of the Withdrawal Agreement. The various categories of citizens and family members affected include:<\/p>\n<ul>\n<li><strong>family members of EU citizens<\/strong>\u00a0who have returned home after having resided in another Member State as recognised by the Court of Justice\u2019s ruling in\u00a0<a href=\"http:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A61990CJ0370\">Case C-370\/90<\/a>\u00a0<em>Surinder\u00a0Singh<\/em>\u00a0and subsequent cases;<\/li>\n<li><strong>primary carers of the children<\/strong>\u00a0in education of migrant workers or former migrant workers under <a href=\"http:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A32011R0492\" target=\"_blank\" rel=\"noopener\">Regulation 492\/2011<\/a> on the free movement of workers as recognised by the Court of Justice\u2019s rulings in\u00a0<a href=\"http:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX:62008CA0480\">Case C-480\/08<\/a>\u00a0<em>Teixeira<\/em> and\u00a0<a href=\"http:\/\/eur-lex.europa.eu\/legal-content\/EN\/ALL\/?uri=CELEX:62011CJ0147\">Joined Cases C\u2011147\/11 and C-148\/11<\/a>\u00a0<em>Czop and Punakova<\/em> and subsequent cases;<\/li>\n<li><strong>primary carers of Union citizens<\/strong>\u00a0having a right of residence in the EU citizens\u2019 home country arising from the Court of Justice\u2019s ruling in\u00a0<a href=\"http:\/\/eur-lex.europa.eu\/legal-content\/EN\/ALL\/?uri=CELEX%3A62009CJ0034\">Case C-34\/09<\/a>\u00a0<em>Ruiz Zambrano<\/em> and subsequent cases.<\/li>\n<\/ul>\n<p>The EU Rights Clinic also seeks assurances over <a href=\"https:\/\/www.newstatesman.com\/politics\/brexit\/2017\/09\/home-office-confirms-it-wont-adopt-controversial-proposals-eu-citizens\" target=\"_blank\" rel=\"noopener\">previous commitments given by the UK<\/a> concerning the interpretation of \u201clawful residence\u201d under EU law and the waiving of all requirements for inactive EU citizens to have held \u201ccomprehensive sickness insurance\u201d while living in the UK.
