If you wish to attend, please contact Dr Edward Canterian at E.Kanterian@kent.ac.uk

Legality and Legitimacy: From Weimar 1932 to Bucharest 2012?

This is a one-day workshop, focusing on the relation between the legal and political order in constitutional democracies in a time of crisis. Taking the Weimar crisis of 1932 as a departure point, we will investigate the contrast between Carl Schmitt’s and Hans Kelsen’s approach to this crisis in order to gain insights about the recent constitutional crises in Romania and Hungary. The workshop will be based on a close reading of selected chapters in David Dyzenhaus’ monograph “Legality and Legitimacy: Carl Schmitt, Hans Kelsen and Hermann Heller in Weimar” (1999), and the application of his findings to recent developments in Romania and Hungary.

The workshop is interdisciplinary. Participants include members of the departments of philosophy, law and international studies of the University of Kent, and members of the EU Commission, and decision-makers in the Romanian and Hungarian political and and legal systems.

Time: Saturday, 6 April 2013, 11:00-16:00

Location:
Brussels School of International Studies (BSIS) Wilson Room University of Kent at Brussels Pleinlaan 5
1050 Brussels

Participating institutions:
University of Kent, Departments of International Studies, Philosophy, Law University of Bucharest, Department of Political Science European Inter-University Centre for Human Rights and Democratisation, Venice

Organisers:
Dr. Edward Kanterian, Department of Philosophy, University of Kent, e.kanterian@kent.ac.uk<mailto:e.kanterian@kent.ac.uk>
Prof. Iulia Motoc, Constitutional Court of Romania, iulia.motoc@fspub.unibuc.ro<mailto:iulia.motoc@fspub.unibuc.ro>
Dr. Eleanor Curran, Department of Law, University of Kent, e.a.curran@kent.ac.uk<mailto:e.a.curran@kent.ac.uk>
Prof. Harm Schepel, Brussels School of International Studies, Brussels, h.j.c.schepel@kent.ac.uk<mailto:h.j.c.schepel@kent.ac.uk>

Confirmed participants:
Dr. Sebastian Payne, Kent, j.s.payne@kent.ac.uk<mailto:j.s.payne@kent.ac.uk>
Dr. Sinead Ring, Kent, s.ring@kent.ac.uk<mailto:s.ring@kent.ac.uk>
Dr. Deana lewis d.lewis@kent.ac.uk<mailto:d.lewis@kent.ac.uk>
Dr. Joanna Pearman j.pearman@kent.ac.uk<mailto:j.pearman@kent.ac.uk>
Dr. Connal Parsely, Kent, C.Parsley@kent.ac.uk<mailto:C.Parsley@kent.ac.uk>
Dr. Maria Drokopoulou m.drakopoulou@kent.ac.uk<mailto:m.drakopoulou@kent.ac.uk>
Dr Anneli Albi, Kent/Brussels, a.albi@kent.ac.uk<mailto:a.albi@kent.ac.uk>
Dr. Albena Azmanova, Kent/Brussels, A.Azmanova@kent.ac.uk<mailto:A.Azmanova@kent.ac.uk>
Dr. Cristina Arion, EU Parliament, kittyarion@yahoo.fr<mailto:kittyarion@yahoo.fr>
Dr. Anna Dimitrijevics, European Commission, Anna.DIMITRIJEVICS@ec.europa.eu<mailto:Anna.DIMITRIJEVICS@ec.europa.eu>
Dr. Julia Lendvai, European Commission, Julia.LENDVAI@ec.europa.eu<mailto:Julia.LENDVAI@ec.europa.eu>
Dr. Anna Iara, European Commission, Anna.IARA@ec.europa.eu<mailto:Anna.IARA@ec.europa.eu>
Zoltan Gyenes, zoltan.gyenes@ec.europa.eu<mailto:zoltan.gyenes@ec.europa.eu>
Wolf-Dieter Besche, wolf-dieter.besche@ec.europa.eu<mailto:wolf-dieter.besche@ec.europa.eu>
Cosmin Cercel, Cosmin.Cercel@nottingham.ac.uk<mailto:Cosmin.Cercel@nottingham.ac.uk>

11:00-13:00pm First session: From Hobbes to Weimar – Dyzenhaus on Legality and Legitimacy

11:00-11:10 Introduction
11:10-11:25 Eleanor Curran: The Problem of Legality and Legitimacy in Hobbes
11:25-12:00 Edward Kanterian: Dyzenhaus on Legality and Legitimacy – Lessons from Weimar?
12:00-13:00 Discussion

13:00-14:0 Lunch and coffee break

14:00-16:00 Second session: Legality and Legitimacy in Hungary and Romania
14:00-14:20 Anna Dimitrijevics: Hungary’s recent political and legal developments
14:20-14:40 Cristina Arion: Romania’s recent political and legal development
14:40-16:00: Discussion: From Weimar 1932 to Bucharest 2012: Lessons for the present?

Dear all, Five places are available at this workshop organised by Kent Law School taking place 6th April.
